Statement on the Supreme Court’s Decision Regarding the IAJD of Mortgages

Once the informative note from the Plenary of the Third Chamber of the Supreme Court regarding the tax on documented legal acts (IAJD) was known, and while awaiting the final ruling, the associations of credit entities would like to make the following considerations:

• The Supreme Court has confirmed that, as has been the case up until now and in accordance with the legislation in force for more than 20 years, the taxpayer of the tax in the constitution of mortgages is the borrower. This decision aligns with the legal framework of countries in our environment.
• The decision made today by the Supreme Court preserves the legal certainty necessary for the proper functioning of the market.
