Protocols Law 8/2021
The Attorney General’s Office, the banking associations (AEB, CECA, and UNACC), and the Bank of Spain signed a collaboration protocol in July 2023 to ensure the autonomy of people with disabilities concerning banking services and products.
This agreement has established the channels for banking practice to be adapted to the new legal treatment of disability set by the legislation (Law 8/21), which enhances the ability of people with disabilities to make their own decisions, and allows for the progressive implementation of necessary adaptations so that they can operate independently in the banking sector, including, among others, information in accessible language.
On the other hand, the protocol contemplates the dynamic functioning of a working group that addresses the issues that compliance with the law may reveal in the daily banking operations, so that not only solutions are proposed but also applied in an agile and efficient manner for the benefit of the collective, whose rights protection is one of the duties of the Attorney General’s Office.
Furthermore, the Attorney General’s Office and the banking associations signed a second complementary protocol on the same date, the objective of which is the protection of the property interests of people with disabilities or those in certain vulnerable situations.
This agreement facilitates a smooth communication between banks and the competent territorial public prosecutors< to report situations that may jeopardize the economic security of the holder, revealing abuses or undue influence on their will, which will trigger an investigation by the Public Prosecutor’s Office.
